Hindi tama o hindi p’wedeng aprubahin at ipatupad ang iminumungkahing ordinansa ni Palawan Board Member Winston G. Arzaga na magbabawal pangingisda sa loob ng 10.1 hanggang 15 kilometro mula sa baybayin, para pagkakitaan sa mga karagatang-munisipyo sa Palawan o commercial fishing.

Noong Disyembre 11, 2023, dineklara ng Malabon City Regional Trial Court (RTC) Branch 170 ang mga Seksyong 4(58), 16, at 18 ng Republic Act No. 8550 (The Philippine Fisheries Code of 1998) bilang unconstitutional o hindi sang-ayon sa batas ng Pilipinas.

Ayon sa Provincial Legal Office (PLO), sa pamamagitan ni Atty. Lara Mar O. Cacal, hindi maaring ipatupad ang ordinansa ni Board Member Arzaga na may pamagat na “Establishing a provincial policy framework for the regulation of commercial fishing activities within the 10.1-15 kilometer zone of municipal waters, providing guidelines for municipal ordinances, and for other purposes”.

Ayon sa PLO, ang desisyon pa rin ng Regional Trial Court (RTC) sa Section 4(58), 16, at 16 ng Republic Act No. 8550 o ang Philippine Fisheries Code of 1998 ang susundin.

“As such, this Office (PLO) opines that the decision of the RTC declaring Section 4(58), 16, and 18 of Republic Act No. 8550, as amended stands. In view of the foregoing, we are of the opinion that the proposed ordinance may not be validly enacted”.
